Health GC Terms of Service

Santa's AI Lab Inc. ("we", "us", "our") provides the mobile application, Health GC, through its website located at https://www.myhealthgc.com/ (the "Site") and related services (collectively, such services, including any new features and applications, and the Site, the "Service(s)"). The Service is designed to be an AI-powered healthcare navigation and management platform to help users organize and manage their healthcare journey and that of their family members, subject to the following Terms of Service (as amended from time to time, these "Terms of Service").

These Terms of Service are effective as of the date you first create an account with Santa's AI Lab Inc. or otherwise use or access a Service, whichever is earlier. These Terms of Service do not have to be signed in order to be binding. You indicate your assent to these Terms of Service by creating an account or otherwise using a Service. If you are registering for an account or using the Service on behalf of an entity or other organization, you are agreeing to these Terms of Service for that entity or organization and representing to Santa's AI Lab Inc. that you have the authority to bind that entity or organization to these Terms of Service (and, in which case, the terms "you" and "your" will refer to that entity or organization).

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THE AGREEMENT TO ARBITRATE REQUIRES (WITH LIMITED EXCEPTION) THAT YOU SUBMIT CLAIMS YOU HAVE AGAINST US TO BINDING AND FINAL ARBITRATION, AND FURTHER (1) YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST SANTA'S AI LAB INC. ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, (2) YOU WILL ONLY BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ON AN INDIVIDUAL BASIS, AND (3) YOU MAY NOT BE ABLE TO HAVE ANY CLAIMS YOU HAVE AGAINST US RESOLVED BY A JURY OR IN A COURT OF LAW.

1. Description of Service

Core Service Description

Health GC is an AI-powered mobile application that acts as a general contractor for healthcare management. The Service helps users:

  • Organize and manage health records and medical documentation

  • Navigate the healthcare system

  • Track medical conditions and healthcare journeys

  • Manage healthcare information for themselves and family members

  • Access AI-powered assistance for healthcare navigation

Protected Health Information

The Service is HIPAA-compliant and designed to securely handle protected health information (PHI). By using the Service, you understand and agree that:

a) Data Storage and Security:

  • All health information is stored on HIPAA-compliant Google Cloud Platform infrastructure

  • We implement industry-standard security measures to protect your health information

  • We maintain compliance with all applicable HIPAA regulations and requirements

b) Permitted Health Information: You may submit the following types of health information through the Service:

  • Medical records and documentation

  • Test results and lab work

  • Treatment records and history

  • Insurance information

  • Healthcare provider information

  • Appointment records and notes

  • Other health-related documentation

c) Use of Health Information: We will only use your health information as described in our Privacy Policy and as permitted by HIPAA regulations, including:

  • To provide and improve the Service

  • To help you manage your healthcare journey

  • To generate insights and recommendations through our AI systems

  • As required by law or regulation

2. Access and Use of the Service

Registration Requirements

  • You must be at least 13 years old to use the Service

  • Users under 18 must have parent or guardian approval

  • You agree to provide accurate, current, and complete information

  • You are responsible for maintaining the confidentiality of your account

Managing Others' Health Information

You may only manage health information for others if:

  • You are the legal guardian or have documented legal authority

  • You have explicit permission from the individual

  • You are the parent/guardian of a minor

  • You have medical power of attorney or similar legal authority

Service Limitations and Disclaimers

a) Role of AI:

  • The Service uses artificial intelligence to assist with healthcare navigation and organization

  • AI recommendations are for informational purposes only

  • AI functions do not provide medical advice or diagnoses

b) Service Limitations: The Service is NOT:

  • A medical provider or healthcare service

  • A substitute for professional medical advice

  • A diagnostic tool or medical device

  • A provider of emergency medical services

  • A replacement for direct medical care

c) Healthcare Decisions:

  • All medical decisions should be made in consultation with qualified healthcare providers

  • The Service does not recommend specific medical treatments

  • Users should verify all information with their healthcare providers

Emergency Situations

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY. The Service is not designed to handle emergency situations and should not be relied upon in emergencies.

3. User Conduct and Responsibilities

Prohibited Activities

You agree not to:

  • Submit false or misleading health information

  • Impersonate healthcare providers or medical professionals

  • Use the Service for emergency medical situations

  • Share or distribute others' private health information

  • Attempt to bypass security measures

  • Use the Service for any unlawful purpose

User Content and Data

You retain ownership of your health information while granting Santa's AI Lab Inc. necessary licenses to:

  • Store and process your information

  • Provide the Service functionality

  • Improve AI systems (using anonymized data only)

  • Comply with legal requirements

4. Privacy and Security

HIPAA Compliance

We maintain HIPAA compliance through:

  • Regular security assessments

  • Employee training

  • Technical safeguards

  • Administrative controls

  • Physical security measures

Data Protection

We protect your data using:

5. Payment Terms

  • Violation of these terms

  • Misuse of the Service

  • Extended periods of inactivity

7. Disclaimers and Limitations

Medical Disclaimers

  • The Service does not provide medical advice

  • Consult healthcare providers for medical decisions

  • No provider-patient relationship is created

  • Emergency services are not provided

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SANTA'S AI LAB INC. SHALL NOT BE LIABLE FOR:

  • Medical decisions or outcomes

  • Healthcare provider actions

  • Emergency situation responses

  • Data loss or breach beyond our control

8. Dispute Resolution

Arbitration Agreement

  • Disputes will be resolved through arbitration

  • Class actions are waived

  • Individual claims only

  • Small claims court option preserved

Healthcare-Specific Disputes

  • Medical malpractice claims are not covered

  • Provider disputes are excluded

  • HIPAA violations follow regulatory procedures

9. Changes to Terms

We may update these terms with:

  • 30 days notice for material changes

  • Immediate effect for legal compliance

  • Notice via email or app notification
